Collaborative Family Law
Collaborative Family Law is a method of settling family disputes using attorneys who are specially trained and committed to helping their clients achieve mutually beneficial solutions without involving the court. The court system is adversarial and public in nature, and has limited remedies to offer families. Trials are physically and emotionally draining in addition to being lengthy and expensive. The courthouse is usually not the best choice for handling all of the legal, financial and highly emotional issues involved in a divorce or other family dispute.
In contrast, Collaborative Law gives the clients a private, confidential setting to work through their differences. They can come up with creative, customized solutions for issues involving property, debts, financial support and children that maximize financial security and meet the particular needs of their family, without being limited by what the law allows. It gives them control over the outcome instead of leaving the decisions about their lives in the hands of a judge. It also teaches the clients how to communicate more effectively with each other, which is essential if children are involved.
Each client consults privately with his or her attorney throughout the process, but settlement discussions occur in a series of 2-hour joint meetings with the clients, their attorneys, and other neutral professionals as needed. The attorneys and neutral professionals (typically a neutral financial professional and a neutral communications coach) guide the clients through a structured process designed to achieve agreed-upon resolutions that meet the stated goals and interests of both clients. Clients commit to be honest with each other and disclose all property and
debts so that they may divide them equitably. No one can go to courthouse or even threaten to do so. All participants agree to treat each other with respect and dignity, and all efforts are focused on settlement.
